These Terms of Service (the “Terms”) govern your access to and use of Dropfeed. By using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Dropfeed (the “Service”), you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts and Security

  • You are responsible for all activity that occurs under your account.
  • Maintain the confidentiality of your credentials and notify us of any unauthorized use.
  • Provide accurate and complete information and keep it up to date.

4. Acceptable Use

  • Do not violate any laws or the rights of others.
  • Do not attempt to probe, scan, or test the vulnerability of the Service without authorization.
  • Do not interfere with or disrupt the integrity or performance of the Service.
  • Do not upload or transmit malicious code, or abusive, harassing, or infringing content.

5. Beta Access

Features labeled as “Beta” or made available through early-access programs are provided for evaluation and testing. Beta features may be changed, suspended, or discontinued at any time and may not be suited for production use. You understand and agree that Beta features are provided “as is.”

6. Subscriptions and Billing

  • Paid plans, when offered, will be billed in advance on a recurring basis.
  • You authorize us to charge your payment method for subscription fees and applicable taxes.
  • Unless otherwise stated, subscriptions renew automatically until canceled.
  • Fees are non-refundable except where required by law or explicitly stated.

7. Data Privacy and Security

We implement reasonable technical and organizational measures to protect your data. Your use of the Service is also governed by our Privacy Policy. You are responsible for configuring the Service in a secure manner for your use case.

8. Third-Party Services

The Service may integrate with or provide links to third-party services. We do not control and are not responsible for third-party services. Your use of such services is subject to their terms and policies.

9. Intellectual Property

The Service and all related content are owned by Dropfeed or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted to you, no rights are transferred.

10. Service Availability; Modifications

We may modify, suspend, or discontinue the Service (or any part) at any time with or without notice. We will not be liable for any modification, suspension, or discontinuation.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DROPFEED AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify, defend, and hold harmless Dropfeed and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service or violation of these Terms.

14. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflicts of law principles. Any disputes arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to the jurisdiction of such courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
